State of Emergency: Fines And Imprisonment For Offences Under New Amendment

A person who commits an offence under the Emergency Powers Regulations is liable on summary conviction to a fine of $100,000 and imprisonment for a term of five years.

This amendment was added to the Emergency Powers Regulations on Tuesday. It was inserted after Regulation 20, which outlines how the Defence Force will assist during the State of Emergency.

The original document was published on Monday night, following the declaration of the State of Emergency. Law enforcement officials maintain that the SOE is necessary to clamp down on violent crime, particularly offences involving high-powered illegal weapons.

The amendment, included as Regulation 20A, was added to the Emergency Powers Regulations on 31st December 2024. It outlines the penalties for offences committed during the State of Emergency.
