Attorneys representing the Tobago House of Assembly and Chief Secretary Farley Augustine have described the legal action taken by the Attorney General against the Chief Secretary and Deputy Chief Secretary Watson Duke as a wasteful litigation.
Via a letter sent to the AG’s office, Attorney Kiel Taklalsingh said the issue that appears to be raised in the proceedings concerns the ability of Mr. Duke to hold the positions of President of the Public Service Association, as well as Member of the Recognition Board, while also having been appointed as the Deputy Chief Secretary of the Assembly.
However, as Mr. Duke has already resigned from the PSA and only holds the position of Deputy Chief Secretary, the THA’s attorneys believe the proceedings have become academic and serve no useful public purpose.
The THA’s legal team believes the claim should be withdrawn adding that if the AG’s team fails to do so they will apply to the Court to have the action struck out as being academic.
Lawyers for the THA are expected to file their affidavits on January 5th while the Attorney General’s affidavits are expected to be filed on January 10th.
